CONTRACT LAW

We provide businesses and professional individuals with the formalization of agreements in order to prevent future conflicts and discussions. For businesses this includes having a set of general terms and conditions, appropriate to the sector or industry. We assist our clients in the drafting and negotiating of and advising on the terms of contracts in any legal area in both national and international setting. We also advise on contract management for your business and on disputes occurred during the performance of contracts and provide possible solutions.

DATA PRIVACY + DATA SECURITY

Curaçao has its own local Data Privacy ordinance and also has to comply to some extend with the rules for data protection as established in the EU regulation, GDPR (www.eugdpr.org). This entails that this regulation is applicable to all organizations, whether it be governmental, private or non-profit, that have databanks consisting of data/information (digital or hard copy) of people residing or working in or traveling through the EU.

AML/CFT

We have also obtained a CAMS certification and have the necessary Anti- Money Laundering and Anti-Counter Terrorist Financing knowledge to keep your company abreast on the latest developments.

CORPORATE LAW

We can assist you with various corporate matters such as: management buy -outs, mergers and acquisitions, reorganizations, due diligence and KYC compliance, shareholders disputes, drafting or reviewing corporate resolutions and agreements, corporate advice and litigation.

INTELLECTUAL PROPERTY

We manage trademark registrations and are trademark representatives registered at the Bureau for Intellectual Property Curacao for clients and assist clients in protecting their interests in- and out of court.

REGULATORY COMPLIANCE

Laws and regulations come with challenges. We have ample experience in dealing with regulatory bodies, assisting clients with audits from Regulators and advising on regulatory compliance, and assist as well in enforcement proceedings brought by domestic and international regulatory authorities.

EMPLOYMENT LAW

We assist both employers and employees in and out of court, and also offer legal advice and support to HR departments of companies, we assist with termination or immediate dismissal proceedings in court or termination permit requests through the Ministry of SOAW, we offer legal tailormade solutions such as drawing up employment manuals, drafting redundancy plans or provide the necessary assistance for collective labor law issues including collective dismissals, assist on employment law issues during reorganizations and provide employment law workshops.

AVIATION LAW

We assist clients with aircraft title registrations and other legal formalities such as pledge and mortgage registrations. There is also experience with Cape Town Registration, as well as legal assistance with aircraft financing and drawing up several aviation contracts such as sale (and lease back), including applying for the necessary flight permits and we provide legal advice on complex legal cross border aviation issues.

FAMILY LAW

We assist you in- and out of court in your family law issues such as: parental plans and parental arrangements, divorce petitions by joint request or on behalf of one party, family law proceedings regarding custody disputes, or (child / partner) alimony disputes, recognition and denial proceedings and curator appointment procedures in case of incapability of managing his/her own affairs, and name changes.

Our primary focus is the prevention of disputes and proceedings. But if proceedings in Court are inevitable we make sure to assist our clients in such way to achieve the required legal results as much as possible.

Transparency when it comes to our fees: We work in a cost-efficient way, and communicate our fees in advance to ensure our clients that they’ll not receive any unexpected fees. The traditional billing by the hour is not the only way we bill our clients. We also work with fixed fees or subscription fees.

OUR VISION

Mediation enables clients to resolve their conflicts in a non-litigious manner. As a MfN and ADR Registered mediator, Mrs. G. Daal acts as a neutral third party to get couples or parties to “Yes”. In the mediation process, she is not the lawyer for either side. Rather, she is there to guide the parties to come to solutions for their dispute and in the putting together of the agreement. For example, for parties that are going to divorce, a covenant can be drawn up through mediation and thereafter it’s also possible to file a petition for divorce and to represent the parties in court. Conflicts at the workplace are also ideally suited for mediation, especially if the parties have to go through one door again in a durable relationship, but exit mediation is also done regularly where the mediator guides the parties to a settlement / termination agreement.

The mediation process is a non-adversarial method to come to an agreement facilitated by a trained mediator. Couples can avoid the high conflict that often accompanies litigation, by using mediation.

In most cases a mediated matter will be resolved quicker and costs substantially less than litigation. The process involves meeting with the other party and the mediator to discuss and resolve the issues that need to be settled. This has several advantages over traditional conflict resolution, among them cost -effectiveness, durability, and a process that promotes respect instead of prolonging hostility.

Mediation is also possible if the conflict has already been escalated to Court, then the case will be put on hold and will be referred to a mediator. We believe in allowing each party equal time to speak their minds. We do not stand above you, but we are the neutral middle person beside both of you. Our goal is to get couples or parties through the process as quickly as possible as they would like, but we will spend as much time as needed.

Mrs. G. L. Daal LL.M

FOUNDER

Mrs. G. L. Daal LL.M obtained her Law degrees at the Erasmus University in Rotterdam, where she obtained two master degrees; in Private law and in Corporate law. She is an Attorney at Law since 2004, the year when she joined Ernst & Young’s legal team. Since then, she has always allocated her knowledge to large international companies and also to local businesses and professionals. During the diverse experience she gained as an Attorney at Law, the realization grew that some disputes lend themselves more to mediation than to legal proceedings. That is why, since 2011, she also offers services as a MFN and ADR Register Mediator.

Giolina was a member of the Board of Rotary Club of Curaçao during the period 2017-2018 and has been a member ever since. She has also served in the Executive Board of the Stichting Beroepsopleiding Advocatuur, a Foundation focused on enhancing the know-how of the profession of Attorneys in Curaçao.

Furthermore, she has served as a lecturer at different legal workshops.

Giolina Daal is an attorney at law with in-house legal corporate experience, she is a legal counsel for years for large international companies with a Head Office in Curaçao. During her extensive experience as a senior inhouse legal counsel she is known to be a practical out- of- the- box thinker for complex legal issues, a good team worker, providing efficient legal services with tailormade solutions.

As a mediator, she mediates several disputes including workplace mediation and family law disputes.
